NATIONAL BANKING AND FINANCIAL CONERENCE

A new integrity and ethics bill to be debated by parliament once it is opened.

This was said by the Attorney General Prof Githu Mwigai in a National Banking and Finance Conference hosted by the Kenya institute of Bankers to talk about the new constitutional dispensation and its implications for the banking and financial sector.  

The entrancement of leadership in integrity in the constitution is a key attribute of good governance and major milestone in the development of a culture of transparency and accountability in Kenya.

Professional societies and groups have a duty to ensure that their members possess and practice this idea.

“We believe ourselves that this country will benefit from the leadership of committed professional and bodies that are both ethical and professional” said the attorney general.

Business institutions should uphold the rule of law and fight corruption. This promotes highest standards of integrity and ethics.

“The banking sector should put in place the rule of rods and measures that inculcate a culture of integrity, honesty forthrightness in the banking profession” said the AG.

The attorney general assured the business community that The Mutual Legal assistance act has been put in place

“We have issued mutual legal assistance requests to more than 6 countries and we have had very substantial response from 4 countries.” added the Attorney General.

Furthermore the proceeds of crime and Anti money laundry act has been enacted.

“This is a very important tool in the hands of the law enforcers. This is to ensure we track proceeds of crime and be able to monitor money laundry making us to be a step ahead of the organized criminal elements that have historically exploited the banking and financial system in this country.” said Mr Mwigai.

Kenya is likely to become the destination of investment full of modernized business when the reviewed and revamped business legislations are put to place. These are the revamped companies’ bill and the insolvency bill.

“A new project meant to be running by next year is an automation program that is funded and implemented by the republic of Singapore which will enable one to text or e-mail the state law firm and have his or her business name reserved, have his or her memo and article of association accepted, get to pay the fee online and have the certificate mailed to the individual.” said Mr Mwigai.

The Justice has gone electronic this is by putting in place an short message service (SMS)

“If you have any complaints regarding you matter or issue which you want to raise to the judiciary by SMS 5834 you will be able to get a response within a short while and someone will follow up on your complaint” said Mr Daniel Musinga

An electronic case system is also put in place to ensure efficiency and efficiency. An audio recording of the court proceedings will be put in place and the chief justice will be giving an annual state of the judiciary progress.

Furthermore we should not fear the Judges and Magistrates but we should instead respect them.
